1. PURPOSE AND ACCEPTANCE

This Legal Notice governs access to and use of the website redlookacademy.com (hereinafter, the “Website”), which is owned by SENSIA SOLUTIONS, S.L. (hereinafter, “SENSIA”) and through which SENSIA provides information about the training activities it organises under the name RedLook Academy in relation to its infrared imaging technology.

Accessing the Website confers the status of user and entails acceptance of the terms set out in this Legal Notice, in the version published at the time of access. SENSIA may amend these terms to reflect regulatory, technical or organisational changes. Any amendments will be published on this page, together with the date on which it was last updated.

Registration for and participation in RedLook Academy courses, sessions and other activities are governed by the Terms and Conditions of Participation, which participants accept through the registration form. In matters relating to such participation, the Terms and Conditions of Participation shall prevail over this Legal Notice.

“RedLook” and “RedLook Academy” are names used by SENSIA to identify its technology and training activities. They do not correspond to a legal entity separate from SENSIA.

SENSIA has not subscribed to any code of conduct.

3. COMMUNICATIONS

Users may contact SENSIA by using the email address specified in the preceding section or by writing to its registered office. Enquiries concerning RedLook Academy activities may also be sent to redlook_academy@sensia-solutions.com.

4. CONDITIONS OF ACCESS AND USE

Access to the Website is open and free of charge, except for the cost of the internet connection, which shall be borne by the user. Certain content intended for participants in RedLook Academy activities is password-protected.

4.1. Restricted-access content

SENSIA provides participants registered for the relevant activity with the password required to access restricted content. The password is confidential and intended exclusively for use by the participant, who must not disclose it to third parties or publish it. SENSIA may change or deactivate the password at any time, particularly once the activity has ended.

The materials available in this restricted area are also subject to the intellectual and industrial property and confidentiality provisions contained in the Terms and Conditions of Participation.

4.2. Proper use of the Website

Users undertake to use the Website and its content in accordance with the law, good faith and this Legal Notice and, in particular, not to use them to:

1. Disseminate unlawful, offensive or discriminatory content or content contrary to public policy.
2. Introduce viruses or harmful software, or carry out any action that may alter, interrupt or damage the Website or the systems of SENSIA or any third party.
3. Attempt to gain unauthorised access to restricted areas or circumvent the technical measures protecting the content.
4. Reproduce, distribute, communicate to the public or adapt the content without the authorisation of its owner, except where legally permitted.
5. Impersonate another person or provide false information through the forms.
6. Collect data relating to other users or send unsolicited commercial communications.
7. Users shall be liable for any loss or damage caused to SENSIA or to third parties as a result of a breach of these obligations.

4.3. Disclaimer of warranties and liability

The content of the Website provides general information about RedLook Academy activities and SENSIA’s technology. It does not constitute technical, regulatory or compliance advice applicable to any specific installation.

SENSIA endeavours to ensure that the Website remains available and that its content is accurate and up to date but does not guarantee that the Website will be free from interruptions or errors. To the extent permitted by law, SENSIA shall not be liable for any loss or damage arising from the unavailability of the Website, the presence of harmful software that could not have been detected using reasonable security measures, or any use of the Website contrary to this Legal Notice.

4.4. Reporting unlawful content or activities

Any person who becomes aware that the Website, or a webpage linked from it, contains information that is unlawful or infringes the property or rights of a third party may report it to SENSIA at lopd@sensia-solutions.com, identifying themselves and providing details of the infringement.

Once SENSIA has actual knowledge that the information is unlawful, it shall act diligently to remove it or prevent access to it.

4.5. Links

The Website contains links to third-party websites, such as SENSIA’s corporate website or mapping services. SENSIA does not operate or control third-party websites and shall not be liable for their content or availability, or for the processing of personal data carried out by their respective owners, which shall be governed by their own policies.

Any person wishing to establish a link to the Website must direct the link to its home page, must not reproduce its content within frames or use framing techniques, must not imply the existence of a relationship with SENSIA where no such relationship exists and must not establish the link from a webpage containing unlawful content. SENSIA may request that any such link be removed at any time.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY

The content of the Website, including texts, photographs, images, videos, graphics, diagrams, training materials, software, design and source code, as well as the trade marks, trade names and distinctive signs displayed on it, including “SENSIA” and “RedLook”, are owned by SENSIA or by third parties that have authorised their use.

Access to the Website does not entail the assignment or licensing of any rights over such content or signs, except for the right to view them for personal or internal professional use. Their reproduction, distribution, communication to the public, adaptation, extraction or reuse without SENSIA’s prior written authorisation is prohibited.

SENSIA expressly reserves the use of the Website content for text and data mining purposes, including the training of artificial intelligence systems, for the purposes of Article 4(3) of Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market.

6. DATA PROTECTION AND COOKIES

The processing of personal data relating to users and RedLook Academy participants is governed by the Website’s Privacy Policy. Information about the use of cookies is provided in the Cookie Policy.

7. GOVERNING LAW AND JURISDICTION

This Legal Notice shall be governed by Spanish law. Any dispute arising in connection with it shall be submitted to the courts and tribunals having jurisdiction in accordance with the applicable legislation.

This Legal Notice is drafted in Spanish. If a translation is published, the Spanish-language version shall prevail in the event of any discrepancy.

El presente Aviso Legal regula el acceso y la utilización del sitio web redlookacademy.com (en adelante, el «Sitio Web»), del que es titular SENSIA SOLUTIONS, S.L. (en adelante, «SENSIA») y a través del cual SENSIA da a conocer las actividades formativas que organiza, bajo la denominación RedLook Academy, sobre su tecnología de imagen infrarroja.

El acceso al Sitio Web atribuye la condición de usuario e implica la aceptación de las condiciones recogidas en este Aviso Legal en la versión publicada en el momento del acceso. SENSIA podrá modificarlas para adaptarlas a cambios normativos, técnicos u organizativos; las modificaciones se publicarán en esta misma página con indicación de la fecha de su última actualización.

La inscripción y la participación en los cursos, sesiones y demás actividades de RedLook Academy se rigen por los Términos y Condiciones de Participación, que el participante acepta en el formulario de inscripción. En lo relativo a dicha participación, los Términos y Condiciones prevalecen sobre este Aviso Legal.

3.     COMUNICACIONES

4.     CONDICIONES DE ACCESO Y UTILIZACIÓN

El acceso al Sitio Web es libre y gratuito, salvo el coste de la conexión, que corresponde al usuario. Determinados contenidos, destinados a los participantes en las actividades de RedLook Academy, están protegidos mediante contraseña.

4.1.        Contenidos de acceso restringido

SENSIA facilita la contraseña de acceso a los contenidos restringidos a los participantes inscritos en la actividad correspondiente. La contraseña es confidencial y de uso exclusivo del participante, que no podrá comunicarla a terceros ni publicarla. SENSIA podrá modificarla o dejarla sin efecto en cualquier momento, en particular una vez finalizada la actividad.

Los materiales disponibles en esta zona quedan sujetos, además, a las cláusulas de propiedad intelectual e industrial y de confidencialidad de los Términos y Condiciones de Participación.

4.2.         Uso correcto del Sitio Web

El usuario se compromete a utilizar el Sitio Web y sus contenidos conforme a la ley, a la buena fe y a este Aviso Legal y, en particular, a no emplearlos para:

1. Difundir contenidos ilícitos, ofensivos, discriminatorios o contrarios al orden público.
2. Introducir virus o programas dañinos, o realizar actuaciones que puedan alterar, interrumpir o dañar el Sitio Web, los sistemas de SENSIA o los de terceros.
3. Intentar acceder a áreas restringidas sin autorización, o eludir las medidas técnicas de protección de los contenidos.
4. Reproducir, distribuir, comunicar públicamente o transformar los contenidos sin autorización de su titular, salvo en los casos legalmente permitidos.
5. Suplantar la identidad de otra persona o facilitar datos falsos en los formularios.
6. Recabar datos de otros usuarios o enviar comunicaciones comerciales no solicitadas.

El usuario responderá de los daños y perjuicios que cause a SENSIA o a terceros por el incumplimiento de estas obligaciones.

4.3.         Exclusión de garantías y de responsabilidad

Los contenidos del Sitio Web tienen carácter general e informativo sobre las actividades de RedLook Academy y la tecnología de SENSIA. No constituyen asesoramiento técnico, regulatorio ni de cumplimiento aplicable a instalaciones concretas.

SENSIA procura que el Sitio Web esté disponible y que sus contenidos sean exactos y estén actualizados, pero no garantiza la ausencia de interrupciones o errores. En la medida en que lo permita la ley, SENSIA no responde de los daños derivados de la falta de disponibilidad del Sitio Web, de la presencia de programas dañinos que no haya podido detectar con medidas de seguridad razonables, ni del uso del Sitio Web contrario a este Aviso Legal.

4.4.         Comunicación de contenidos o actividades ilícitas

Quien tenga conocimiento de que el Sitio Web, o una página enlazada desde él, contiene información ilícita o lesiva de bienes o derechos de terceros puede comunicarlo a SENSIA en la dirección lopd@sensia-solutions.com, identificándose e indicando la infracción. SENSIA actuará con diligencia para retirar o impedir el acceso a dicha información cuando tenga conocimiento efectivo de su carácter ilícito.

4.5.         Enlaces

El Sitio Web incluye enlaces a sitios de terceros, como el sitio corporativo de SENSIA o servicios de mapas. SENSIA no gestiona ni controla los sitios de terceros y no responde de sus contenidos, de su disponibilidad ni del tratamiento de datos que realicen sus titulares, que se rige por sus propias políticas.

Quien desee establecer un enlace al Sitio Web deberá dirigirlo a su página principal, no podrá reproducir su contenido dentro de marcos (framing) ni dar a entender una relación con SENSIA inexistente, y no podrá hacerlo desde páginas con contenidos ilícitos. SENSIA podrá solicitar la retirada del enlace en cualquier momento.

5.     PROPIEDAD INTELECTUAL E INDUSTRIAL

Los contenidos del Sitio Web (textos, fotografías, imágenes, vídeos, gráficos, diagramas, materiales formativos, software, diseño y código fuente), así como las marcas, nombres comerciales y signos distintivos, incluidos «SENSIA» y «RedLook», son titularidad de SENSIA o de terceros que han autorizado su uso.

El acceso al Sitio Web no supone la cesión ni la licencia de ningún derecho sobre dichos contenidos o signos, más allá de su consulta para uso personal o profesional interno. Queda prohibida su reproducción, distribución, comunicación pública, transformación, extracción o reutilización sin autorización previa y por escrito de SENSIA.

SENSIA se reserva expresamente el uso de los contenidos del Sitio Web para la minería de textos y datos, incluido el entrenamiento de sistemas de inteligencia artificial, a los efectos del artículo 4.3 de la Directiva (UE) 2019/790, sobre los derechos de autor y derechos afines en el mercado único digital.

6.     PROTECCIÓN DE DATOS Y COOKIES

El tratamiento de los datos personales de los usuarios y de los participantes en RedLook Academy se rige por la Política de Privacidad del Sitio Web. El uso de cookies se explica en la Política de Cookies.

7.     LEGISLACIÓN APLICABLE Y JURISDICCIÓN

Este Aviso Legal se rige por la legislación española. Las controversias que puedan surgir se someterán a los juzgados y tribunales que resulten competentes conforme a la normativa aplicable.

Este Aviso Legal se redacta en español. Si se publica una traducción, en caso de discrepancia prevalecerá la versión española.
